Overview

Employee State Insurance Act is applicable for organizations employing more than 10 permanent persons and wages of such employees are less than Rs. 21,000/- per month. It is mandatory for all the employers to get the Employee state insurance registration if they meet the above criteria. The registration needs to be taken within 15days once they reach the employee headcount of 10.

Under the ESIC Scheme the employer needs to contribute an amount of 3.25% of the total monthly salary payable to the employee whereas the employer needs to contribute only 0.75% of his monthly salary every month of the year. The only exemption to the employee in paying his contribution is whose salary is less than Rs. 176/- per day.

In case of failure to get ESIC registration online or not fulfilling ESI return filing procedure, the organization shall be liable for a fine of INR 10,000/-.

Medical Benefits

Incase of sickness and major diseases benefits are provided to the employee. Sickness benefits at the rate of 70% (in the form of salary), in case of any certified illness and which lasts for a maximum of 91 days in any year.

Maternity Benefit

Maternity benefits to those women who are pregnant, such as paid leave and medical benefits.

Death Benefits

If the death of the employee happens while on work – 90% of the salary is given to his dependents in the form of a monthly payment after the death of the employee, along with the funeral expenses.

Disability Benefits

If any employee gets disabled while on work – 90% of the salary will be given to him in the form of a monthly payment after the disability of the employee.

After the registration ESI Returns have to be filed twice a year. The following documents are required for the filing of the returns:

No, ESI filings is required only if the company has ESI registration.
However, it is mandatory to get the ESI registration for a company only if the employee strength of the company crosses 10 employees.
If a company voluntarily wants to get the ESI registration then it must have minimum 6 employees.
There are two types of claim.
  • Accident/death/sickness/maternity cash benefit.
  • Medical bill reimbursement. For medical claims, contact your dispensary and for cash benefit as described above at 1., contact your ESIC branch office.
